What My Clients Asked Me This Week- What is a Prove Up?
Q. What is a prove up?
A. That is a great question!
A “prove up” is a term for a final hearing regarding a divorce proceeding. It is usually no more than thirty minutes and conducted in front of a judge in open court. At a prove up, the court hears some brief testimony from you. Then it reviews your judgment or settlement agreement to make sure all of the requirements have been met and that the agreement is fair and complete.
To prove up is to bring proof of one’s right to something, specifically to show that the requirements for receiving a divorce have been satisfied.
A hearing is an opportunity to be heard, in this case, by a judge.
